I am studying at an Engineering college in Mumbai. I have passed my final year and went to collect the final marksheet from the college. But the college is not providing me the document because I am not willing to pay a certain membership fee. I have already cleared all my tuition and other related fees up to my last semester. No dues are left. Now they are asking to pay TSDW membership and Aluminai Association fees which cost Rs. 1500 each. These fees are not a part of the institute fees and I am not interested in the membership but they are forcing me to pay or else I won't get my marksheet or any other documents. Already the tuition fee is around 1.5 lakhs and these additional unuseful membership fees. Any legal solution?

A.Dear client,
this is against the law. Colleges do not have the right to withhold mark sheets or any other certificates if you do not clear your entire dues. Please send a legal notice to the college authorities. If this doesn't work out, please file a suit against your college to recover your marks card

A.Dear Client,

In the prevailing situation, you need to go through the prospectus you get at the time of admission to the college carefully and you also need to go through the college records/archive to find out if any such general circular or notice was notified by the College for the purpose which is applicable to all students on roll of the College or it is optional for the interested students and make an application in writing to the Principal/Head of the College if you do not find any provision for payment of TSDW membership and Aluminai Association fees either in prospectus or in notice/circular file. If the payment of said fees is applicable to all students on roll by circular or otherwise, your standalone approach or objection may not work even through litigation and in case you found it optional, then the college cannot force you to pay the same for return or release your mark sheet or degree. If so happens you may consult with an Advocate for guidance and steps. But as a student, you must represent your grievance before the college on the basis of information you gathered from the above-stated sources.
