Hi,
Recently I bought a property from individual buyer and he has shared photocopies before the regsitration but we did not checked whether he has original property document or not based on mutual trust, Now after proerty registry he refused to give original property documents, we suspect that whether he has loan against property or original property has been lost, what are legal ways to get the original property document from buyer to avoid any legal issues in future.

A.Dear Client,

Without searching the status of the encumbrance of the title of the land or property, you bought the property from the seller and get it registered in your name. This ia a serious lapse on the part of the Buyer who is solely responsible for such a lapse. No fiduciary relationship exists between a seller and buyer in the matter of transfer of title of any immovable property, for which you have to face lot of consequences. Reach out to an Advocate for getting a certified copy of said property from the Registration Office and search out the encumbrance status by Court Searching. If the status found disputed which the seller intentionally did not disclose before the transaction then as suggested by the Advocate take necessary legal action against the Seller.

A.Dear client,
You can file a specific suit for performance of agreement asking court to direct seller to fulfil his promise in agreement.
Additionally, a duplicate/certified copy can be pulled out from the Sub Registrar Office
