I am the maternal grandmother of a minor girl. My daughter died 10 days after the birth of the child. Since then, the child has only been with me.

I have two cases in the High Court.

Firstly, I have challenged the order passed by the Family Court against me. It has an MA.

Second, C. Misc. On the same court but with a different bench. This is against the change/amendment in the daily order by the Hon'ble Judge.

Family court hearings were held daily. Through the application, I obtained the certified copy of the daily order from the Family Court. After one month, I again took a certified copy of the daily order from the family court. But I am surprised that the order about two months ago was changed, for which I had also filed a case in the High Court. But the shocking oral order given by the High Court said that you attend the daily hearing in the District Family Court, we will hear the case after the Family Court case is over. But after 6 years, from April 2023 MA case has started again. But C. Misc. Still pending and not coming in the list even after several attempts.

I would like to club/merge C. Misc with MA case so that I may try to convince the Hon'ble Judge that the trial in the Family Court was not conducted in a fair manner. Is it possible to club or merge the two together?

A.Dear Client,
In the given situation, you may make an appeal before the Hon'ble High Court praying for a summary trial for both cases, If Court finds merit in your appeal may be allowed and heard accordingly. You can also file an interlocutory application before the Dist. Family Court for early hearing and disposal of the case. Consult with your Advocate for proper guidance and steps.
