Will and share in property Will and share in property

Hi, we are three siblings. Our father owned a flat in his name. He passed away 3 years back and has left a will stating all three sons will get 33 33% share in his property. My elder brother wants to keep the flat and wants to pay me and my younger brother 33.33%. Elder brother wants to keep the flat as well as his share of 33.33%. Is this right according to law. According to me if he is keeping the flat he should pay me and my brother 50% each. Please confirm

A.Dear client,
Everyone is only entitled to a third of the share, and if you believe your elder brother's comments, it could lead to a perilous situation in which he takes ownership of the flat and refuses to pay even 33.33%. Accept only cash or demand draughts and never cheques.

All are entitled for only 1/3rd share and if you believe the words of your elder brother it may create dangerous situation because he may take possession of the flat and deny payment of even 33.33%. Better take cash or demand draft and never accept cheques. Please be in possession of the flat.
