Ancestral property dispute.
Sir, my father partitioned our ancestral agri land during 1986. Mutation registry was prepared by revenue inspector and tahasildar. During 2009 I have got 50000 loan from bank. RTC record is on my name since from 1986. My sisters file partion suit. Whether all my sisters are eligible for share sir?. Kindly answer it.
A.Dear Client,
The partition of ancestral agricultural land in India is governed by various state-specific laws, as land is a state subject. One common law that governs the partition of ancestral property is the Hindu Succession Act, 1956. This law applies to Hindus, Buddhists, Jains, and Sikhs.
According to the Hindu Succession Act, if the property is ancestral, i.e., it has been inherited up to four generations of male lineage, then all the male members of the family would have a right to a share in the property. The term "male members" also includes females who fall under the category of "coparceners."
However, please note that the specific details of your case, such as the state in which the land is located, the specific provisions of the state law, and the documents provided by you, will determine the applicability and extent of the rights of your sisters in the partition suit.
Thank you.
