My father expired few years ago and my mother is neurological patient and in her current state of mind she is not capable enough to make sound decision. She has a property which belongs to her name through Nomination after father's death. In such case if we the children plan to make sale of the property what is the ideal way in doing it on behalf of our mother who cannot make the decision on her down. We are 4 children in total.

A.Dear Client,
Here are some general steps you can consider:

Guardianship or Power of Attorney: If your mother is incapable of making decisions due to her medical condition, you may need to explore the possibility of obtaining legal guardianship or a power of attorney over her affairs. This would allow one or more of the children to act on her behalf.

Guardianship: If your mother does not have a power of attorney in place, you may need to petition the court for guardianship, which would grant someone the legal authority to make decisions on her behalf, including selling property. The process and requirements for guardianship can vary by jurisdiction, so it's essential to consult with an attorney who specializes in elder law or guardianship matters.

Power of Attorney: If your mother is still capable of understanding and signing legal documents, she may be able to grant one of you a power of attorney to act on her behalf in property matters. However, if her mental capacity is in question, this option may not be feasible.

Court Approval: In some cases, the court may approve the sale of the property on behalf of an incapacitated individual even without formal guardianship if it is in the individual's best interests. Again, this would require legal proceedings and court approval.

Family Agreement: If all the siblings are in agreement, you might consider having the siblings who are capable of making decisions sign a family agreement or memorandum of understanding outlining the decision to sell the property and how the proceeds will be distributed among the siblings. However, it's important to consult with a legal expert to ensure that such an agreement complies with the laws in your jurisdiction.

Consult an Attorney: Given the complexity of the situation and the legal requirements involved, it is strongly advisable to consult with an attorney who specializes in estate planning, elder law, or property law in your jurisdiction. They can provide guidance on the best approach and help navigate the legal processes involved in selling the property on behalf of your incapacitated mother.
Thank you.
