I SOLD MY PRIVATE CAR ( DELHI RC) TO OLX AUTO( SOBEK AUTO INDIA LTD GURGAON) ON 10TH MAY 2023- THEY PROOVIDED ME POSSESSION RECIPT AND WITH COPY OF NOC INTENDED TO TRANSFER CAR TO RTO FARIDKOT PUNJAB DATED 15TH JUNE 2023. NEXT OWNER HAS NOT MODIFIED RC UNTIL DATE IE 14TH OCT 2023.SELF HAS GIVEN WRITTEN COMPLAINT TO MY NEAREST POLICE STATION IN DELHI. WHAT ELSE I SHOULD DO ??

A.Dear Client,
Once a buyer has agreed to buy the car then on receipt of the value or price of the vehicle, the seller/owner of the vehicle is called on to discharge necessary formalities, that is sell verification regarding the transfer of ownership of the vehicle in compliance with the standing procedures as laid down under the Motor Vehicles Act, 1988 and Rules, 1989. There are statutory forms to be signed both by the ex-owner and the present owner to process the transfer of ownership of the vehicle and change of address. As per the Act, once a vehicle is sold, the purchaser has to submit statutory forms and other required documents along with transfer fees within 30 days to the concerned RTO/Registering Authority for processing the transfer of ownership of the vehicle and change of address in the Certificate of Registration (RC) failing which the applicant Buyer has to pay fine or penalty for delay in submission of application for transfer of ownership(TO) and change of address(CA). When more than five months have passed after delivery of your old vehicle and if the running vehicle is used by the Buyer/New owner without transferring ownership of the vehicle and in case the vehicle met with an accident, theft or any other violation of the MV Act, you being an owner as per the record, may face the legal consequences arising out to that accident or violation. So, to protect your interest and safety and to avoid all sorts of unwanted consequences, you need to write to the concerned RTO informing the date of sale of your old vehicle enclosing a copy of all the relevant documents you receive or possess in connection with the sale of vehicle. These documents will be crucial in any legal proceedings. Try reaching out to OLX Auto to inquire about the status of the car transfer. They may have an explanation for the delay and can potentially expedite the process. You can contact the Regional Transport Office (RTO) in Faridkot, Punjab, to check whether they have received the application for the transfer of the car and the progress of the transfer process. They might be able to guide you on the next steps.

If OLX Auto is uncooperative and the RTO has not received the transfer application, you can file a complaint with the RTO explaining the situation and the delay in the transfer. They may be able to take action against the buyer for non-compliance. Your lawyer can send a legal notice to OLX Auto and the buyer, highlighting the non-compliance and the legal consequences they might face if they don't complete the transfer within a reasonable timeframe. Continue to follow up with your local police station in Delhi regarding your written complaint.
