Dear Sirs, My name is Muhammed F R. I was living in Oman 12 years with y family& I was returned to India to cancel my existing Job visa and go back to Oman with new job visa. When i came back to India, after one week time, my wife told me please transfer the child visa from mine to her company visa. So I send email to my last company and they changed my children's visa to my wife visa .After this there is no messages and WhatsApp is blocked by wife ,and after two days , their family members came to my home and told they need divorce, now i am here in India and I was blocked in WhatsApp and I am unable to even see my childrens.Actually i am on a trap now. They are telling my wife dont need and she want divorce. But I am ready to take care my wife and childrens but she is refusing . They even didn't apply any legal notice to me , only verbally their relatives came to my home in India(Kerala) and told this divorce. As per Indian Law , how i can get at least my children's , if she is not willing to accept me. I don't understand what i will do now.

A.Dear Client
Familiarize yourself with the Indian laws pertaining to child custody. In India, the welfare of the child is of paramount importance, and the court will make decisions that are in the best interest of the child. If your wife and her family are not engaging in an amicable resolution, you may need to initiate legal proceedings. This may involve filing for child custody or visitation rights through the family court in the jurisdiction where your family resides. Collect any evidence that can support your case, including past communication, financial support records, and any other relevant documentation that can demonstrate your involvement in your children's lives and your commitment to their well-being. Explore the option of court-ordered mediation or counseling services. These services can help facilitate communication and reach an agreement that works for both parties and, more importantly, ensures the well-being of the children.

Till the date you are not receiving a summon, you do not need to worry about the divorce case. For custody, you can apply in the court of your jurisdiction.
