Illegal Construction and Invasion by neighbours Illegal Construction and Invasion by neighbours

Hello, We live in a multi-storey building of 2 floors. We live in the upper floor, as per the housing rules and market customs the ones living on ground floor can construct their house till their gates i.e on thier entire yard however this would lead to extension of roof from normal buildup area to yard end. In such a case the upper house residents can use roof's upside portion as a chhat and need to ensure they dont cause any harm to it. My neighbours have constructed a big roof which ttakes over our area as they have started building it higher from the mid level- 17 inches on our wall. They have also made a permanent staircase to facilitate their and their tenants movement. They come up anytime and trouble us by entering our chhat area, spoliing our plants, creating noises. this is the only case of invasion in our row of houses. please advise on legal action. Police was involved earlier during construction as big fight was started, but they made fake promises and didnt follow it. Kindly Advise

A.Dear Client,
To address these concerns, you may want to consult with a property or real estate attorney who can provide advice tailored to the specific laws and regulations in your jurisdiction. Document the instances of intrusion, damages, and any fake promises made by your neighbors. A legal professional can guide you on potential legal actions, such as sending a cease and desist letter, pursuing a civil lawsuit for trespassing or nuisance, or exploring mediation to resolve the dispute amicably. It's crucial to have a clear understanding of your rights and responsibilities, as well as gathering evidence to support your case. Engaging legal counsel will help you navigate the complexities of this situation and seek a resolution that protects your interests.
