Marks of selected candidate through RTI Marks of selected candidate through RTI

If a candidate got selected in university as assistant professor. Can we sought information of his marks / dcore through RTI. Is his marks a third party information or is it a public information. Please suggest me in this regard wirh documentary evidence.

A.Dear Client,
As per Section 2(f) of the Right to Information Act, 2005, "information" means any material in any form, including records, documents, memos, e-mails, opinions, advice, press releases, circulars, orders, logbooks, contracts, reports, papers, samples, models, data material held in any electronic form and information relating to any private body which can be accessed by a public authority under any other law for the time being in force. However, the information sought by a citizen may be denied by the Public Authority under section 8(1)(j) of the Act, under the following two circumstances – a) Where the information requested is personal information and the nature of the information requested is such that it has apparently no relationship to any public activity or interest; or b) Where the information requested is personal information, and the disclosure of the said information would cause an unwarranted invasion of the privacy of the individual. In the case of Vinay Arora v. UPSC in File No: CIC/UPSCM/A/2017/122611, Date of hearing: 19.07.2018, the CIC, Delhi in an appeal filed u/s.19(3) of the RTI Act ruled out that only marks of the appellant can be provided. The rest of the sought-for information is third-party information exempted u/s 8(1)(j) of the RTI Act, hence the same cannot be provided to the appellant under the relevant provision of the RTI Act. So, in view of the above citation, you cannot seek information with regards to the marks of a selected candidate from the Public authority under the RTI Act, 2005 which is third-party information and exempted from disclosure u/s 8(1)(j) of the RTI Act.
