ST- SC Land Sale Enquiry in Uttarakhand ST- SC Land Sale Enquiry in Uttarakhand

In Uttrakhand
Can An ST / SC person who owns 50 Naali
Sell 2 or 3 Naali Out of it To
Another Person ?
( Belonging to a General category )
With permission from SDM or DC

Someone told us that
An ST / SC person has to retain 62.5 Naali for Himself as per the Rule
If he Haas Excess Naali above 62.5 Then He / she can Sell it to another Person ( belonging to a general category )
But the ST / SC person needs to keep Minimum 62.5 naali for Himself
Is this True ?

Also If it is Once possible to Sell the excess Naali
Can that land be converted from Agricultural Land to Non agricultural Land Under section 143

I would Love Proper Legal Opinions on this Matter
From Experts like you on this Website
Thank you

A.Dear Client,
Section 42 of the SC, ST Act prohibits the sale of SC land without approval. This law was enacted to protect the interests of the SC/ST tribe. However, you can acquire SC land by obtaining authorization from the DM or the collector. There are some cases where SC/ST land cannot be sold after 143 conversions in Uttarakhand. These cases include: If the land is being sold to a member of the same caste or community. If the land is being sold to a government agency. Section 42 (SC, ST Act) prohibits the sale of SC land without approval. This law was enacted to protect the interests of the SC/ST tribe in Uttarakhand.
