Hello sir/madam

My father own a house on a land, we are staying here from more than 30 years. We have our buying paper, i.e the legal paper on which it's written that we bought the land. Now, we want to build another house in our land, but neighbour is saying he will put stay on our construction and saying negative things.
I want to know is there any way anyone could stop our construction? We own the land, we have land buying legal paper documents, we are also staying here from past so many years. Can he actually put stay on us ? And on what basis ?

A.Dear Client,

To construct another building on the same land, obtaining approval for the building plan from the municipal authority is a prerequisite. If your neighbor attempts to hinder the construction by obtaining a court injunction on potentially frivolous grounds, you can contest the case in court to have the injunction lifted. After successfully contesting the case and having it disposed of or dismissed, you can take legal action against your neighbor. This may involve serving a legal notice and filing a counter-complaint before the magistrate. Alternatively, you can file a First Information Report (FIR) with the police station, citing sections 182 and 211 of the Indian Penal Code (IPC) against your neighbor for filing a false case.

A.Dear Client,
First of all, for the construction of another building on the same land, you have to get permission or approval of the building plan from the concerned municipal authority. Your neighbor can seek a court injunction on the said construction on the frivolous grounds to harass otherwise, but the injunction may be vacated, once the case is contested properly before the Court. Once the case is disposed or dismissed, serving a legal notice, you can file a counter-complaint before the magistrate or file an FIR to the concerned police station u/s 182 and 211 of IPC against the neighbor who has filed a false case against you.
