Complaint against the Postal Department
A Speed Post article was posted at my original address three years ago. I still haven't got it and it has cost me dearly. How can I file a complaint against the Postal Department?
A.Dear Client,
As per Section 69 of the Consumer Protection Act, 2019, a complaint must be filed before the Consumer Forum within two years from the date of the cause of action. In the case of non-receipt of a speed post article posted three years ago, the statutory time limit prescribed under Section 69 of the Act has expired.
However, there is still a possibility to file a complaint before the Consumer Court. You can submit a petition for the condonation of delay along with your complaint. In this petition, you should provide cogent grounds explaining the reasons for the delay in filing the complaint. If the court finds merit in your petition, it may allow your complaint to proceed. The decision on whether to admit or reject your complaint, taking into account the condonation of delay, will be made on the day of the admission hearing.
It's crucial to consult with a legal professional who can guide you through the process and help you prepare a strong petition for condonation of delay.

A.Dear Client,
As per Sec.69 of the Consumer Protection Act, 2019, a complaint is required to be filed before the Consumer Forum within two years from the date of the cause of action. Non-receipt of a speed post article posted three years ago is now barred by time as prescribed under Sec.69 of the Act. However, you can still file a complaint before the Consumer Court along with a petition for a condonation of delay explaining therein cogent grounds behind the delay in filing the complaint and if your petition deserves merit, then the Court may allow or reject your complaint itself on the day of admission hearing of the complaint. Reach out to an Advocate for guidance and steps.
