My wife has filed a DV case u/s 12,18,19,20,21,22 & 23. Maintenance of 50k & Comp of 50 lacs claimed. We are married since 5.5 yrs with no kids. She earns 70k net. I am unemployed since 5 months. On what grounds will court decide maintenance and compensation? Will my previous years IT return be considered? How are false allegations of verbal/physical abuse factored by court?

A.Keep proving the court that you are unemployed and cannot pay anything and also provide evidence to the court that your wife is earning an amount of 70K per month which is more than enough for her living provided that both of you don't have any kids.

A.Dear Client,
It depends on the court to give orders on maintenance. All you can do is that you can provide reasons on your WO why she should not be provided any maintenance. Now it is on the court to decide the rest.
