Hello sir.
Need some help from your side. One of my family friends file a divorce case against his wife. In the family court on the basis of adultery. And he put me there as a third party. And he also file a adultery case in criminal court against his wife and me.
But now both of them are going to sign a document in which both of them were agree to live with each other for next two years and give each other another chance. After two years of they found that they can't manage to live with each other. Then any one of them can file a divorce case again. And because of this agreement. The husband is agree to withdraw both the cases. The divorce case and the adultery case in criminal court. So I want to know Sir. That after two years can ipc and Indian law allow that guy to put a adultery case in criminal court against me. Cause a judge who is my friend told me that if he withdrawal the adultery case this time. Then according to law he never file a adultery case against me and his wife in any court. Cause he already withdraw that case once. Is that true Sir. That he can't file a adultery case again on me.

A.dear client in your matter With due respect to your friend who happens to be a justice, the husband of that lady can file a case against you for adultery.The difference of opinion lies here.He can file a case against you for adultery, but he has to prove adultery committed by you in the course of two years, wherein they both have agreed to live together and try to make things right.He cannot file a case of Adultery on you citing the relationship you had with his wife before the said period of 2 years.You may consult for any further advice in this regard

A.Yes, if he has withdrawn adultery vase against you once, he cannot file on same ebent . Hoever, he can file as if it is a new occurrance on a different date.

A.First with all due respects to your judge friend`s opinion and that of others here, I am of the opinion that the criminal case filed by husband of that lady was not maintainable in Law, it would have failed anyway. ( People have misunderstood the adultery Law, but I do not want to teach it here ). Secondly, if you continue any sort of contact with that lady which her husband can show, he may file a civil suit again.

A.No, He cannot as because this withdrawal will hurt his credibility unless the adultery committed is caught red handed.
