Hi Sir, needed legal advice on the below situation:
My brother is having an account with SBI. He had made an online purchase (Flipkart) on 21.03.2017 for Rs.8619.00. The transaction was cancelled by the him and he received the refund

twice on 28.03.2017 and 03.04.2017, erroneously twice by the banking system. Again he made an online merchant (Flipkart) purchase of Rs.10655.00 on 28.03.2017. The transaction was cancelled by the him and got refund on 23.04.2017 & 25.04.2017, erroneously twice by the system. He got only 1 SMS for each these refunds and out of confusion he used the excess money.
He realised this only when he received a phone call from the branch after 6 months or more. He later found that SBI had created an overdraft account (in his savings bank) without his knowledge. He decided not to continue with the SBI account anymore and submitted an application to close the account. We tried our level best to convince the Branch Manager to close the
overdraft account but all in vain. We are looking to refund the excess amount however, we request the bank
1) To submit a written apology to my brother for this SBI's system goof-up, creating an over draft account and not accepting the application for closing the account
2) Waive-off the pending dues or some settlement because of bank's system failure as a compensation for mental agony and restoring the trust on the nation's largest bank as they cannot play around with public money.
