HI i married on Nov 2015, when i was pregnant i use to go office and pay money to my mother in law,I am only child my mother stay alone and i use to give money to her she use to work as cook at others home.After my mother in law asking money from my mother ,but i told her my mom will not pay u money then she told her son and that tme i was 6 month pregnant.Husband had hit me and she also started hitting me..afterward i was admitted to hospital and doctor said that they is change of giving premature birth,listening to these my mother in law and husband said to my mom to take me and pay the hospital from that i was with my mom and she taken care for me .I had a baby girl which these my in law and husband did not like and started pertaining in front of everyone that they are happy. My husband and in law lie a biggest thing that my in mother law and sister in law is hiv positive .After hearing these me and family said stay away from them because they can do anything...then my husband use to come and ask for money and started hitting .i filled 4 time NOC against but police also failed ...he is not giving divorce also and now my daughter 3 yrs old i and my mom take care of her and me ...from 2015 to till date i am facing and hitting from him ,Today also he hit me ..Please suggest me ur option ..Police is also not helping ..I want to save me and my daughter,even he hit my daughter

A.Dear Madam,
You may approach Higher Police officer and also file different cases like DV, maintenance under Section 125 of Cr.P.C etc.

A.You need to lodge a FIR Immediately.
If the police is not helping you need to write it to the superior authorities and even if they dont help.
File a Section 156(3) CrpC.

Next,
1. File a 498A Case for Dowry
2. File a Section 12 DV Case for Domestic Violence
3. File a Section 125 CrPc for Maintenance

After all this you file for your Divorce (Contested in Nature)

A.Hi client,
If the police isn't working , file a clause 156(3) of Crpc , where the Court will direct them to take action. Next you can file a maintenance against him where your advocate will accordingly draft for the money you need for your and your child's daily needs. You can file a 498(a) against him and his family members. Along with all this you have to apply for contesred divorce.

A.Dear Client,

After reading your case, there are 3 options available to you, which are as follows:-
a) Stress on filing of FIR u/s 498A of IPC with other sections,
b) Filing of Domestic Violence case u/s 12 of the PWDVA for reliefs such as maintenance, protection, custody, etc.
c) Filing of Divorce Petiton in Family Court.

Dis you file a case against your husband? if you do not file a case how police help you? It is better that you can go to police station and file the case first.If police is not taking the care then you can approach the higher police officers or court.
