A. Yes. You first have to issue a statutory notice under sec. 80 of the Civil Procedure Code, and then file a case seeking compensation for damages caused by dereliction of duty.

What happens if Respondents file a appeal against Tribunal courts order in High court with respect to recruitment process ?

Generally High Courts will not interfere in order of Tribunals.
High courts will interfere in orders of tribunal if and only if
a) When the principles of natural justice are violated.
b) Tribunal has exceeded the brief and passed orders outside of its scope.
Please note that some tribunals have Supreme court has the appellate court and High court may not have the jurisdiction over tribunals.
So, you need to consult a lawyer with your query.
