we booked a flat in January 2017. was supposed to get possession in April 2019. despite pushing the builder for registration the whole year it was not processed. In may 2020 the jharkhand government withdrew a benefit of Re 1 registration cost for women. now because of the delay i have to pay around 3.5 lakh registration fee. should i go ahead with registration or file a notice.

A.Hi
Since there is an abnormal delay in handing over of possession and registration of property by the builder and also that you are incurring financial losses (like losing out on Rs1 Registration -/-) , you can claim these losses from builder by issuing notice to builder and filing a case under Section 12 of consumer protection act .
Loss of right to seek registration under Rs1-/- registration on account of time delays and instead paying out Rs3.5 Lakhs for registration is deemed as negligence and misconduct and hence the builder is liable to compensate you for the same.
In addition to Rs3.5lakhs, You can also claim interest, costs of alternative accommodation for the delayed period of project.

A.Please go ahead with registrations, after handing over the possessions, file a complaint before RERA or consumer forum for delay compensation, loss, rent etc.
