A. Hi,
As per section 18(1) of RERA, in the events where the promoter delays the possession of a property or fails to complete the project within the agreed time as mentioned in the sale agreement, he shall be liable to return the amount received from the buyer in respect of the apartment/property or plot, along with the due . You may send the builder a legal notice regarding the delayed possession.

The facts of the case stated by you are not clear.
However, there is "doctrine of adverse possession", under which a person who is not the original owner becomes the owner because of the fact that he has been in possession of the property for a minimum of 12-years, within which the real owner did not seek legal recourse to oust him.

Obtain a certified copy of the death certificate. It is a requirement in several states.
