Can a wife claim the expenses her father and she has incurred while marriage from her husband if the husband has filed for divorce? Will she have to file Dv case for it? Or does she have any other options in law?

A.Hi,
It will depend upon the discretion of the court. There is no specific provision in Indian law for return of marriage expenses. Even if wife wants to claim it, she will have to prove that she has spent money and the same can be defended.

A.Hi,
There is no specific provision in Indian law for return of marriage expenses. Even if wife wants to claim it, she will have to prove that she has spent money and the same can be defended.

A.Dear Rahul,
It is her discretion whether she wants to file divorce case or DV case against her husband. In divorce case she can claim maintenance, which includes interim as well as monthly maintenance against her husband. If divorce is granted on compromise decree between the both parties then court grants divorce based on the same decree, in which she can demand marriage expenses.
