icon Domestic voilance

My husband and in laws family tortured me and they not to stay in his house and left me before 8 months I m mentally and financial depressed I complains to police they not take any action what I will

A. what police can do ?
nobody can force anybody to live with someone, not even supreme court.

they not stay in his house and left you.
so you have house to stay.
for other financial spends, you can file maintenance case and ask for interim maintenance in it.
you can also send restitution of conjugal rights to husband to come back.

icon Land mutation by will

Dear Sir, My father was a teacher. my self and my sister are the two children to them. after retirement, my father distributed his gratuity and other savings amounts into two parts. one part was given

A. you did right thing.
knowing law is good so your father made 'WILL'.
The land belongs to you.
Hope you made the 'WILL' properly.
but your sister will challenge 'WILL' with the support of mother.
ask your mother to shift with your sister then she will understand reality.

icon MUTUal consent divorce of my relative bro

if wife do and filed mutual consent then the husband need to pay any maintetnence

A. Hi,
No law mandates that the husband has to provide alimony to the wife, it can also be the other way round if needed. The courts do not interfere in the alimony fixed by the couple under mutual understanding and also gives the couple the freedom to walk out of the marriage without maintenance under mutual agreement.

icon Role of Grant of Probate in Partition Suit

Probate of my grandfather property is granted to me in my favor recently in September 2020 by ADJ. Now I am confused whether can i show it to an ongoing partition suit case of the same property which

A. Hi,
Probate is the official proof of the will. It is advisable to produce the probate to the court before the court gives the decision which might not be in accordance to the will. While submitting a probate application, you need to submit certain documents that prove that:
a.The will is genuine and is the last will made by the testator.
b.The proof of death of the testator.
c.That the will is validly executed in clear conscience of the testator.

icon Property dispute

My mother does not want me to live with her due to some misunderstanding between my mother and my wife and me stayed with her from past 3.5 years along with my family and now she told me that this is

A. you living with your mother by leaving your wife for 3.5 years will not get you property.
your sister marital status and age is also irrelevant.
both son and daughter have equal rights in ancestral property.
only the person have right on his/her self-acquired property.
so if property is not earned by your father or mother then only you have right in it.

she might want to save her property from your wife.
