A. As you both have already decided to stay separately currently you may stay separated for six months or so and then you may decide if you would like to go ahead for mutual divorce along with the child custody and who will bear their expenses.

A. Hi Pooja,
If you have not made any documentation work with the money lender of Rs.11 lakhs, then there was no question of repayment to the money lender of giving him Rs.28 lakhs and by default there is no liability by your family if you all have not signed any kind of document. You can always evade it by stating that you are not aware about the loan taken by your father. If things don't improve you can file a case against him in the appropriate police station in your area and if he manages to es ...ReadMore

A. Hi,
You are in a tricky situation. You want to be with your husband, but his overbearing mother is causing you immense hardship. I think the only way for you to resolve this is to sit down with your husband and have an honest conversation with him about it. He has to realize that it is you he is married to, and not his mother.
To save your marriage, it might be necessary that you two live away from your mother in-law. The information about you being thrown out of your house at midnight is deepl ...ReadMore

Want to buy loan defaulted property from housing finance company .the property or flat is seized by fiance company under sarfaesi act.need guidance on what all aspect to check or verify before purchas

A. Hi,
As the property is acquired under law, most of the procedural and technical aspects should be in order. All you'll have to check for is that the company is in actual possession of the property and it is not occupied by someone else. You can also check whether there are any disputed claims with respect to the property, as this can become a problem for you after your purchase.

I am cheated by a tour operator regarding false promise and commitments. He took advanced money in all for our Shimla tour since February 2019 and promised us that arranged tour in Shimla in the March

A. Hi,
You can file a suit for money recovery at the place where the operator resides, carries out business or where you entered the transaction with him, as provided for under Order IV of the Civil Procedure Code. Bear in mind that it has a limitation period of three years, so you cannot file a suit beyond that. So my advice would be to proceed with filing the suit in the appropriate Court immediately. Your documents, receipts and brochure will form part of your submission and will serve to prove ...ReadMore

A. Hi,
Unfortunately, unless you are a workman (daily wage earner), your employer is free to cut your salary as per the terms of your employment contract. There was an order passed by the Ministry of Home Affairs on 29.03.2020 stating that wages had to be paid in full by both private and government employers, but this is exclusively applicable to daily wage labourers.
As an employee, you have the right to take leave, receive timely salary, maternity benefit, protection from harassment, receive gr ...ReadMore

Sharing wedding pictures on fb account without permission of wife is cyber crime

A. Hi,
S.67 of the Information and technology Act deals with publication or transmitting obscene material in electronic form, this is a crime under Indian law. However, wedding photos are not obscene, and it can even be argued that social media platforms were created to facilitate the sharing of such pictures.
So no, it would not be a cyber crime.

A. 20km in cities is not more.
people even travel 100 kms for work.
even many women lawyers travel more than that.
if possible then getting work near home for less salary can be option but people want everything which is not possible.

however it is natural to be tired and due to current stressful working conditions, physical and mental wearout is common and many couples are facing issues of marital duties.

for living separate you dont need law. nobody can force anybody to live with anyone.
