A. Hi,
According to the definition, default is the failure to repay a debt, including interest or principal, on a loan or security. A default can occur when a borrower is unable to make timely payments, misses payments, or avoids or stops making payments. Therefore if there was a non payment of due then it would be considered to be default.

A. Dear Sir,
It seems to be a personal loan and they have no authority to come over to your house for recovery the same since house is not mortgaged. It is a purely personal loan and they have to take a decree from civil Court or Arbitrator. Just ignore their calls and be thick skinned.

A. Hi.Lodge a missing FIR with the local police and then with a copy of that FIR go to the Bank and request them to issue a duplicate bond to you so that you can redeem the bond when you need otherwise you loose all your investment. The bank may ask you to make an affidavit, if they do so then have an affidavit done for the same.
Kindly rate my ans *****, thanks

A. Dear Sir,
Sarfaesi Act not applicable to student and agricultural loans
Parliament today passed a bill which empowers banks to confiscate security in the case of loan default, a development that assumes significance in view of the episode surrounding industrialist Vijay Mallya.
The Enforcement of Security Interest and Recovery of Debts Laws and Miscellaneous Provisions (Amendment) Bill, 2016, will not, however, apply to loans for agricultural land as well as student loans.

A. See the Sahara group case is already in the court and SEBI itself is one of the party who is fighting for the cause of the investors like you so that you can get your money back. As long as the case is going on you will have to wait and watch.

A. Hi,
Nobody can steal what is properly yours until your father has declared your brother the complete owner. Please investigate who is the candidate for your father's FD funds. He just serves as a custodian, ensuring that the deposit reaches a legal heir. When a depositor dies, the nominee has two options. Keeping the FD till it matures is one possibility.

A. If you have a genuine reason for not paying the loan you could contact the bank and ask for relaxation.
So that bank could extend the time period.

A. Reply to the legal notice and ask them to correct their mistake or else you can take the benefit of this mistake of theirs when either they move the case in DRT or you move in any forum against them

A. Hi,
As per your narration, there might have been a gross deficiency by the bank with regards to the services they offer. You can directly approach the ombudsman and register a complaint there or you have the additional option of filing a complaint against the bank before the consumer forum.
If you find my answer helpful then kindly rate me.
