A. Dear client,
as all other approaches are not fruitful, you can approach the court now. An index contains all documents like affidavits, plaints etc. A complaint with the affidavit is a complaint registered in the police station confirming your interest to pursue it. Memo here talks about the issues, laws, facts of the case which your lawyer has to submit initially for a notice to be served to the other party.

you need to speak to your credit card issuer and describe all the issues that you have and request them to restructure the repayment by allowing you to have small EMI which you can pay easily.

A. Yes you are right that there is no banking laws or rules which prohibits one of the joint account holder to access the account on death of another account holder. If the bank is not listening to you then you have these options;
1. Write a complaint letter to the banking Ombudsman
2. Send them a legal notice through a lawyer
3. File a consumer case against them.

A. Hi,
If there was such a clause in the agreement, you can use that as a defense in court and save your property. You have to refer to the agreement deed and in case of any further advice, please contact a lawyer.

I will have to look in to the Companies Act of Tanzania to figure out the rights of the minority shareholder plus the banking laws of Tanzania that how enabled they were legally to take that action. A. If the daughter doesn't give any stop payment direction to the concerned Bank, then the Bank may not insist you to submit the Succession Certificate but will disburse that FD amount to you as Nominee. Please take note that if the daughter gives objection against such disbursement,then to get the Succession Certificate is the only option and in such case mother, son and daughter have such right of inheritance.
