is Special Bailiff Application not allowed in Matrimonial cases?

A. Dear Client,
No special bailiff application is not allowed on cases of matrimonial cases. A special bailiff may be appointed for the execution of a warrant of arrest if service cannot be effected in the ordinary course. The period of such appointment can be determined by the Court concerned in the circumstances of each case but no special fee should be levied.

A. You may file a suit for restitution of conjugal rights against your wife to save your marriage. If your wife is unemployed then she may file case for maintenance against you for which you have to pay her some amount from your monthly income as per the order of the court. Moreover if she gets a decree of divorce by proving the ground of divorce against you and then she may also claim for alimony from you. Therefore if your wife files a divorce case against you, then you need to contest the same.

A. Dear client,
If your husband doesn't talk to you for one reason or another, you should speak to him instead. Start on a positive note by telling him that you love your marriage and care about him. Then, calmly ask what the problem is without making it his fault.
Well, if you consider this as abandonment, then it can be a ground for divorce. But the court might not agree on the same. So, you can file a divorce on any other grounds.

icon Divorce - divorce case against me in Canada

I have been married In India as per Hindu marriage act and have never visited Canada. I was married in 2013 and separated in 2015. My husband has started a divorce case against me in Canada in sep2022

A. Dear client,
If the spouse is residing in any other foreign country, then they can seek divorce by mutual consent under the country's divorce laws related to foreign marriages. The Indian legal system will recognize the divorce only if it is with the consent of both the parties. You might have to contact the Canadian embassy and convey your stand on the case.
If you don't want a divorce, then contact a lawyer to contest in the matter.
