Mediation is necessary before taking the divorce case to the court. You can either go for Mediation through courts under section 89 of Code of Civil Procedure or Private Mediation. Try and resolve your issues at the Mediation Center.

You can either file a mutual consent divorce or a contested divorce on the grounds of cruelty.
Your husband cannot deny paying the alimony in either of the cases.
