icon Divorce procedure in forced marriage

Hello I would like to know the legal process for divorce in forced marriage due to blackmail and also actions I can take from my side legally against them

A. Hi,
Forced marriages are not legal, they are considered void. You can move to court and get your marriage declared void as you had not given free consent for the same and the other party had forced you into it. Once the marriage is declared void, no need of getting divorce will be left. Thank You

Your file can file for divorce on the grounds of Cruelty against you, but if don't have any valid grounds for seeking divorce, you cannot file for it. Your wife and daughter are entitled for maintenance in both the divorces. Thank You

icon Property dispute between husband and wife

Can my wife put some caveat or some other case over my property (house in my mothers name) during divorce proceedings. If I sell this property will there be any legal problem for me.

A. Hi,
Since your mother is the owner of the property, she can sell the property whenever she wishes to. She has rights over the property. You personally cannot sell it since the property is not in your name. Your wife cannot interfere.
Thank You

A. Hi,
As she is the property's co-owner, she has a lawful right to be there. You can try approaching her directly to sort this issue out. Failing this, you can opt for mediation or arbitration.

A. Hi,
File a petition for restitution of conjugal rights. You can then try marriage counselling. In the meanwhile, file a petition for interim maintenance under Section 125 CrPC, this will allow you to claim a monthly amount from him to support yourself.
