A. Divorce cannpt be granted on the basis of speed post. Only the court or JMFC have the rights to issue a divorce Decree.

A. 6 years is a very long time for divorce .If any affidavit , written statement is not submitted by her then you can get one sided divorce.

A. Hi,
The daughter has a legal right of claiming the property owned by her father after he passes.
Supreme Court ruled that daughters have equal rights in their father's property. In its decision, the Supreme Court clarified two points: coparcenary rights are acquired by daughters on their birth.
Therefore she can claim her right as a successor.

A. Yes. You have lots of scope of getting divorce and also your son's custody as he is very much attached to you. You may go for contested divorce as your wife is not ready for mutual divorce. You can win the case if the lawyer has good skills.

A. Hi,
Under law, the husband has a responsibility to maintain his wife in case of divorce. However, if he can prove that the wife earns more than he does, then he can request the Court to waive this obligation.

A. Hi,
If you are convinced that you do not wish to divorce her, you can try marriage counselling in an attempt to work out your differences. She can seek treatment from a mental healthcare specialist to better manage her disorder. However, mental illness is a valid ground for divorce if you wish to go down that route.

Yes, a divorce petition can be filed by your mother against your father. Alimony and maintenance can be claimed by your mother and the court at its own discretion will give her the share in the property. Thank you
