The husband and wife can get a MOU. But the MOU is more like a mutual settlement which has been penned down in writing and acts as a documentary proof of such terms which have been mutually accepted by the parties to the divorce. The MOU cannot stop a couple from fighting or not have any further disputes.

You can approach the court for the restitution of conjugal rights. A decree of restitution of conjugal rights implies that the guilty party is ordered to live with the aggrieved party. If you want a divorce, you can approach the court for that. Please contact a lawyer for further advice.

According to the Muslim law the property would be divided among all thr legal heirs equally. It would be suggested to contact a lawyer having understanding of Muslim law in your city. Although its a general rule that daughters have less share in the property as compared to sons and step children doesn't inherit from step parents.

A. If you are planning to buy that site then to have the clean property you need to have the conveyance deed executed by both the son and the daughter as both of them are legally the owners of the property as per the Muslim law.

A. Hi,
You can seek divorce from your wife on account of mental torture, but the subject of maintenance would depend on the circumstances. Generally, men are considered maintainers of their wife, hence you could be asked to pay for maintenance.

A. Hi,
According to the Indian law, The daughters have the right to share ½ of the share given to the son in the property, which means the son has double the share that the daughters get in that property.
It is further added to your knowledge that Under Muslim law, the person holding the share in the property cannot dispose of more than 1/3rd of the share inherited by them by way of will.
