icon Purchasing of land

I want to buy a land. Land owner has given power of attorney to her husband in year 2004 for selling the land. Can I purchase it ?

A. Hi,
If the wife's Power of Attorney grants her the power to sell, then you can go ahead with the purchase.

We found PoA of property of 1974 in my grandfathers name we get to know later that the house built there was broken down by govt during 1975 emergency .Still there is nothing constructed on the land i

A. Hai,
You will not be vested the good title over the property just because you possess a power a attorney. If a person dies, POA automatically get terminated on death of executant or person in whose favour POA was executed. The laws governing contracts and power of attorney in India are not self-explanatory when it comes to revoking power of attorney. Hence, it is up to the courts to decide upon the same. Please do consult a lawyer for more details. If you found this helpful, please rate us.

It is a bit of a risk, but the property's ownership history can be determined by looking into the encumbrance certificate. If it is all in order, XYZ can proceed with the sale.
