A. A. If you are buying it form the Builder then there should be a registered Development Agreement between the Builder and the Land Owner, not Sale Agreement.
B. Land owner to Builder PoA & Development Agreement should be registered.
C. Builder can sign the Sale Agreement if it has a registered PoA authorizing it to do so.
D. Return of money depends on terms of allotment letter or application form which you may have signed and submitted (as sale agreement has not been executed yet)

but legal remedy depends on state as states law differs for societies.

another thing is the seller is responsible for getting NoC and not buyer.
90k is huge amount. it is illegal.
you can send legal notice first. it will not solve problem but after that you can pay 90k and take possession and then file case on society to recover.

You can approach RERA, Consumer Forum and Adjudicating Authority (NCLT) at the same time.
But, it is important to know, that at RERA and Consumer Forum you can approach as an Individual Home Buyer, but in IBC you will have to be atleast 100 such home buyers together to approach.
