My father has sold 1.5 acre land in 2015 without the concent of my uncles and me. We came to know after 2 year. Now, my uncles are pressuring my father and me to retrieve the land. We inform the buyer that it is unpartioned land and registry of the land is invalid and we stopped them from performing any kind of activities on it. They registered a complaint against me under article 144. What I should do now. Please advice me.

A.It is a civil matter. Ask your uncle to file civil suit for cancellation of sale deed and you can support him indirectly.

A.1. your uncle may file a partition suit.

A.Why and how your consent is required by your father to make sale of a portion of land? If land was inherited by your father then you donot have any independent right to question sale. The fact is that new owner has every right to use the land as per his own and you and your uncle has no right to take law in their hands and to cause threat to the owner. New owner is bonafide pyrchaser and he has independent right over labd. If you have any right then question the sale deed. This platform cannot be misused for illegal criminal activities.

A.Primarily, the sale document has to be seen to understand how your father sold the land without your uncles' signatures. Without perusal of the document, it would be inappropriate to advice you.
However, as an interim measure, you may file a suit seeking injunction or restraining any kind of activity on the land. Independently, a suit should be filed to challenge the sale deed. But these are generalized advices without the perusal of the document.

A.First of all you might have threatened them with weapons, thats why they filed 144. Instesd of that you must get an injunction order from the munsiff court and get stay to all the activities in the property. Later you can partition it.
