What to do sir if a person not returning a money which we give ,what are the sections and procedure of filing case against her. We have all proofs cheques of that person's account but we can't deposit because it's bounce..

A.Theres No Clarity in your question.

For proceeding under N.I.Act you have to deposit the said cheque into your bank account and after clearing if it founds that the Cheque was returned due to inssuficient funds or any other cause in the said cheque return memo.

immediately after receiving the said return memo from bank, consult a advocate and send Demand Notice demanding her to repay the said cheque amount with in 15 days and after she received the said notice, if she fails to repay , you have to file the cheque bounce case with in 30 days from the date of receiving of notice by her.

A.You have not mention the details of Transaction, for what purpose you give the other person money, which is your State, city, Village etc.
if you have all proofs cheques of that person's account & other details of his House etc. If the cheques given by him are Bounced then immediately we can send him Legal Notice for our money in section 138 & we can get our money back. Do not delay in sending Legal Notice from a lawyer. Provide more details of the actual financial transaction & so you can get the money return.

A.If bounced you should have filed cheque bounce case. Share the cheques as Supreme Court extended time for filing such cases. Secondly you can file civil case. Discuss to clear doubts. Please give me Rank 5 if you feel my answer helped you.

A.If you have cheque then bounce it or file money recovery suit under section 138 of NI act.
