Hello All,

I have an ancestral property in Bihar and vocal partition has been done between my father and other three uncles. Now I am looking for a legal way so that my father could not sell this property or make any kind of legal documents to any person. So i would like you legal suggestions so that some kind of legal deed or documents can be made on the name of my mother so that my father could not sell the property or in future even he makes any kind of legal documents to any one including banks in against of any loan amount deemed to be invalid. Registering the property is one way but it requires lot of money which we dont want. If any such document not possible then any other way of locking the property for some certain years so that no liability can be formed on that property.

A.I have gone through your query in detail.
1) Once if the ancestral property is divided between your father and other three uncles that is the total 4 shares so each of you will be getting 25% of the total property so it is extremely necessary that you register that 25% of the ratio in your father and mother name irrespective of the stamp duty and registration charges
2) you will have to pay to the government DO NOT try to avail our such kind of registration as now if you will try to save a few rupees you will be losing the property of lacs & crores so a small request DON'T, be “PENNY WISE POUND FOOLISH” and get your father's and mother's name registered on the ancestral property and secure rights as in your future if things go bad other people may also come to claim their share in this property and you will land up in court fighting for the cases for several years...
3) So don't watch for the money part as ONLY registered documents have the value in court and kindly DO NOT go for any kind of notary documents though somebody will advise you this cheap way..

A.Get Relinquishment Deed done in the name of your mother. No stamp duty involved.
