Annulment

We married together under special marriage act 1954 1 year ago and marriage ceremony also taken place. Now we are separated 3 months . Can i file a petition in annulment decree instead of divorce .

A.No, you cannot file for annulment decree since there is no fraud. The best option is to go for divorce.

A.Annulment of marriage can be possible ONLY when one party said things that weren't true to get the other person to enter the marriage & given all false information or caused a fraud. In your case you can go ahead with divorce as there is NO fraud in your case of marriage. And at last but not the least if you wanted to get separated so early why did you both marry. Also is your other partner ready for Divorce, let us know in more details.

A.Hi, Is there any fraud in your marriage ? Annulment case can be filed with in one year not above one year.

There is provision to file petition for annulment of marriage subject to existence of some conditions ex. at the time of marriage either of spouse already married, fraud commited, and many other grounds etc.
If your case comes under one of those then you can file petition.

A.Annulment of marriage is possible only when the marriage has been constituted in violation of law and rights of other. In any other case the possibility is only divorce

A.no there would be divorce only
annulment is not possible when marriage has been consumed . if both had relation then no question of annulment
