Hi,

We bought a phone from eBay via cash on delivery mode(cost of mobile phone is inr 9347). Later when we started to use it the sim slot was not working so we raised a complaint regarding the default mobile phone so they asked us to reship the product to sellers address and provide them the receipt of shipment from the courier service . We reshipped the product as advised by them through dtdc courier service. Once the product was delivered to the sellers address we took the scan copy of drs (proof of delivery) from the dtdc courier office. Then the receipt, invoice received of the mobile purchase and drs copy was given to eBay for the refund claim.
Later they opened a claim case and request us to get a declaration letter from courier service (format shared by eBay). Somehow we fought and followed up with the courier service people for almost 15 days to get the declaration letter with their seal and signature. Meanwhile eBay closed our claim request for the delay in submission of declaration letter and asked us settle this issue directly from the seller. Then we started to get in touch with seller but they were blocking our number and denying our request by saying that they have not received any courier from us and they also said that they are not working in the address mentioned in the invoice or the bill given to us. Later we again got in touch with eBay and explained about the sellers response to our request. Now this eBay people are requesting so many supporting documents and routing us customer care and inseellers each time when we check with for the status of the refund claim.

As supporting documents we have provided
1. Dtdc courier reciept or acknowledgment where the courier people not mentioned the weight of the product and the value of the product mentioned as 2000.

2.drs copy

3. Declaration letter got seal and signature from the courier service where the complete information required by the eBay has like sellers and customer address, Content in the box , weight of the product , value of the product etc.

4. Invoice which we received while the purchase.

Now eBay requesting us to get the weight of the product and correct value in the receipt again from the courier office which they will not do it since the product the shipped almost a month back from now.
From the last month we are following up with eBay, seller and courier office to get the refund claim processed but till date we are in receipt of neither for refund nor the product.

Please guide us how we can realize this issue and get our money back. It's nearly 10000 that we are loosing.

We would be very grateful if someone can guide us in resloving this issue.

A.Firstly send a legal notice through some advocate both to eBay and the seller.wait for 15 days if you don't receive a refund , then file a case in consumer court. It may take time but ultimately you will get properly compensated
