We got married in 1982, took mutual divorce in 2007 we didn't stop cohabiting ever, and then got our same marriage registred in 2010 with 04/12/21982 date mentioned on the certificate. We did not disclose our divorce while registering our marriage. As we didn't want any formality of remarriage.
Does this registration of marriage legally stands valid?
Mutual divorce in 2007 was taken by us based on some misinformation while looking about getting our child born out of surrogacy. Still have no child. My husband died in 2017 post kidney failure after undergoing dialysis for three years.
During the illness of my husband, we employed a woman as caretaker cume domestic help in 2015. That woman seduced my husband and got married in an Aryasmaj Mandir certificate,
She was made nominee in his BSNL-CHD office as the wife before taking VRS a month before his sad demise and so getting all the DCRG+family pension regularly post the death of my husband in 2017. One house at Zirakpur near Chandigarh registered in my husband's name is also under her illegal possession since then since 2015. My husband was posted at the BSNL Chandigarh office and we were used to living part of the year for specific needs owing to his job and treatment at fortis hospital Chandigarh.
What should be the remedy for me?
She has filed a suit to declare her legally married class I heir and owner of the said house property.
I am living in Firozpur city from inception. I was employed in Railway hospital Firozepur and retired in 2019. I am an issue less widow of a retired govt. servant class I legal heir of my late husband,
Please help me and guide me.
