If my husband files a no fault divorce in Australia can he get child custody if my daughter is staying with me for past 13 years

A.Hi,
You have the option to not appear before the court in Australia if you do not want the Divorce proceedings to be binding on you. If your child is staying with you in India then it is not possible for your husband to get the custody of the child unless he files a case in India for custody.

A.Hi,

A.Dear Madam
If child residing in India them your husband cannot get such order ir respect of child. If you do not appear before Australia court then such ex-parte decree is not binding up on you.
