Property bought on uncle name

My uncle bought proper on his name from the share of family, now he refused to share at the time of partition among his brothers. Few years back a property has been bought and it was registered on my uncle name because my father is not educated and grandfather told that there will be your share in these property since buyer is eldest brother. How the legal handling for these properties.

If the property was bough from the income of the joint family then you have the right to get your share in that property, you can file a suit for partition to get your share in the property.

A.If your uncle bought property while he is in joint family and also purchased property from joint family income than you have to prove in court that this property is purchased from joint family income to increase joint family property.if you have proof of money transactions that money is given from joint family to purchase property than can file suit for partition in court and claim share from that property also.otherwise as property is in your uncle name he is owner of property
