My father 75 years old , he purchased flat long back. but at the time of registration he add the name of my brother as co owner, father purchase the same flat from his own earning { and not from my brothers earning } now my father want to add the name of two unmarried daughters [its me & my sister] in the same flat . my question is what is the process of adding the name ? is father have to take permission from my brother for adding our names? what is the alternate procedure to adding our name?

A.Hi,
Since your brother is the co-owner in the property, prior consent of the brother is required for your father to add names of his daughters in the property.

Since your brother is the co-owner in the property, prior consent of the brother is required for your father to add names of his daughters in the property.

A.Dear Client,
As per your inputs, your father added your brother name as co-owner in the property while purchasing, but not added sisters names, as per the deed if the brother and father purchased the said property jointly from the owner, then your brother have the equal share in the property as your father have, so the best option is your father can write a will deed in the daughter's names to the part of his share, that is the only option available,
if you forward me the sale deed i can get exact details after going through the deed

A.1. your father can gift his share out of the said flat by way of a gift deed,
2. he can safeguard his interest in the gift deed by adding a revocation clause,

A.Dear Sir,
If you are father is absolute owner he may execute Gift Deed in favour of his two daughters to the ratio he likes in their favour for example he may retain 50% and remaining 50% may be gifted out equally to his two daughters. The father may take release deed from the son who seems to be co-owner.

A.When in registration your brother is co-owner, his consent and signature is necessary to add your names. All of you should go to registrar office and make a rectification deed adding your names. If your bro does not agree, you father has to file a suit in the court for adding your names. Pl. give me ratings if the answer is useful to you
