Is building partition is necessary along with its land

I have a family house and properties in Balasore, Orissa. Almost 8 years back my elder uncle did the partition of all the properties there with my father. That time my father was ill and was under treatment (with our permission my elder uncle was looking into it as he was taking care of the treatment costs which was coming from the family property income). That time somehow, he managed to do the partition, my father had a brain injury so I am sure he hadn't done it knowingly, more over in spite of being a doctor had done not sign the partition paper but did finger stamp. We were not aware about this until my father's death.
We have some forcedness that we cannot illegally fight against the partition.
But what I notice, the partition is only done for the land. But a house is situated on that land, not mentioned in partition paper.
My query is, can I conclude that even the land is partitioned, house is still common? And based on that can I fight legally?
