My husband don't want to live with me because he is having affair with one of his colleague . I have one daughter ,she is 11 years old . But he is not admitted that he has having affair. he want to give me divorce but is not ready to give me maintenance, also he is not ready to file the case by himself. He want that i will file divorce case. He threaten me also that once case will be file than he will not allow to stay in my in laws house .
Our property is on the name of mother-in-law.. is there any share for me or on my daughters name .
I am living in separate portion in same house but from last year we are not living as husband wife .
from June20 i was in my parents house and there was no communication between us till Sep 20. My daughter heath was not stable so i had to come back to in laws house .
Can i stay in my in laws house with my daughter during case filing ? My mother-in-law is also with her son.
My husband don't want to live with me and not ready to give maintenance . He is working in pvt .

I don't understand what should i do

A.till date nobody came in our offices and accepted affair, give maintenance and also allowed to live in same house. it is your responsibility to get proof of affair and then prove it.

without it also you can get maintenance and also shelter in house.
It has to be handled properly.

A.Hi,
You can file for a divorce in the court and also claim maintenance. You can also request the court to pass an order for you and your husband to live together so that the differences can be resolved peacefully

A.Hi,
First of all, as a legal wife, you are entitled to get maintenance during your lifetime.
During pendency of the divorce proceeding, you can stay in the In-law house, but you may face both mental and physical torture from your In-laws. So you are suggested to take proper precautions relating to monetary affairs which you are entitled to your husband. In that event, you can take another step by filling one maintenance case before taking any decision of filing a divorce.
