I am from Mumbai, Maharashtra, as my question title suggest, my mom, separated with dad in 1999 and had relinquished / gave up all her right to a commercial property jointly owned by my mom and dad, made an affidavit and notarised that time. but the same was not registered nor any stamp duty was paid at that time. The affidavit made then was submitted to the society for change in the in share certificate and make my father the sole member/owner of the said property in 2005-2006. The society made the changes in the share certificate as requested by my father. Now my father wants to transfer the said property to my name by a gift deed. is it possible? If not then what is the way out?

A.Dear Sir,
Get Gift Deed from your father and try to get transfer in your name. If not agreed approach Civil Court for a direction.
