Husband took my child with my permission because of grandfather illness. Now he is not returning my child. I am capable to take care of my child. He is diverting my child's mind to not live with mumma. He is seven yrs old. Wat if my child choose to live with his dad due to divertion of his mind only. Pls help. He is living with him 45 days.notice has been sent for custody. My concern is if he choose to live with his dad in front of judge.

Now when you will file the child custody case then also you are at low level.
Hence when the case will reach its level, it will be your child to decide. Hence you ave to request the visitation rights and win your child.

A.Hi,
You can stand your ground peacefully in front of the court. Even if the child says he wants to live with one parent, the court will look upon what is in the best interest of the child.

As per your inputs you need your child under your custody, first issue a legal notice to your husband to give back your child, if he do not respond to your notice then file a case in court asking custody of your child
