My aunt (unmarried) owns a 250 sq yds property in Hyderabad but is currently staying in New Delhi. Due to the COVID pandemic she is not able to travel to Hyd. She would like to give SPA or GPA to my sister who is looking after her to sell the property. Can she do so without travelling to Hyd and registering in the Sub Registrar's Office? Can it be notarised in Delhi? Will it be valid in case she passes away?
A.Dear Sir,
She can execute Power of Attorney at New Delhi and get it notarized at New Delhi on her part and other part can be executed in Hyderabad.

A.Hi,
Usually Power of attorney needs to be registered at the Sub-Registrar’s Office, but, A power of attorney is to be registered at the office of the sub registrar within whose jurisdiction the person giving the power resides at the time of execution of the PoA. Though, PoA is not an appropriate procedure to transfer property titles. Also, a PoA remains valid only till the life of the principal.
