Hello, My father has a property house shared with his two brothers. This house was owned by my grandfather who is no more. And now my father wants to give the house to his brother's. He told me that he doesn't need that house but me I don't have any acceptance in that. So I told him that we too need a share in that house so don't leave it. But he is against my will and trying to give the properties to his brothers. This house is owned by my grandfather not my father as I don't want to lose that old house. So I need to know do I have any legal rights on it and how can I stop my father not to write down the property in his brother's name. Waiting for your response.Thank you

A.Hi,
If the house is an ancestral property then you have a claim to it. It is advisable to file for a partition suit.

A.Hi,
If the house is an ancestral property then you have a claim to it. It is advisable to file for a partition suit.

A.if this house falls in the category of ancestral property then definitely you have the sale in the property even if your name is not appearing in the title records if father cannot donate the property and you can approach to the court in this regard to get stay order otherwise you can approach to the court and filed a petition of partition please be aware that according to the value of property in case of partition suit you will have to pay the court fees

A.if your grandfather not left 'WILL' then you have rights in that house.
