If a individual takes property on mortgage, then, how the entry is made in EC ? Automatically ? Or he have to go to the registrar office ? What's the procedure ? Who writes entry in EC ? & on what basis ?
Can it happen if a person takes loan on mortgage, then, entry is not there in EC & borrower cheats many person by his property ?

A.Hi,
All transactions relating to the property that have been recorded by the Registrar will be looked into, and necessary details will be made to reflect in the EC.  
An Encumbrance Certificate or EC is a certificate of assurance that the property in question is free from any legal or monetary liability such as a mortgage or an uncleared loan. Application is to be made to the registration office for an EC, along with an attested copy of proof address, details about the property, its title details, and the fee applicable for obtaining the Certificate. The officer will inspect the Indexes for details in the specified period. And it generally takes 15-30 days from the date of application.
The Certificate usually pertains to a specific period and transactions relevant to that period alone will be considered. Another important consideration is that the EC will reflect only those transactions and documents that have been registered with the office.

A.Hi,
An encumbrance refers to any charge created on any asset, more often used in the context of real estate. The EC for a property is provided at the sub-registrar’s office in which the property has been registered. To ascertain the transactions that have taken place concerning a property-

• Application is to be made to the registration office for an EC, along with an attested copy of proof address, details about the property, its title details, and the fee applicable for obtaining the Certificate.

• The officer will inspect the Indexes for details in the specified period.

The certificate is generally issued 15-30 days from the date of application.
However, All transactions relating to the property that have been recorded by the Registrar will be looked into, and necessary details will be made to reflect in the EC.

A.Dear Sir,
If it is registered document it is the bounden duty of concerned Sub-Registrar to enter such mortgage details in the relevant column of EC register. Sometimes they avoid to enter the same saying that they have forgotten so it is better to get it entered and take copy of it.
