My father have done two marriage. My mother is alive and the second one have a son. My father has property which was gained only by his own not any ancestral property. Now my father had passed away. The second wife had gave a fake case that we were threatened her and her son and demanding legal heir certificate for that second son and share in property. What to do now how to prove the fake case.. What step I have to do.. How to overcome this fake case. And to save our property.. Is there any rights to the second son.. While my mother first wife is alive.. Plz answer

A.Hi,
You can file a complaint against them for fraud and cheating under Sections 415 and 420 of the Indian Penal Code. You may also file a suit for malicious prosecution under S.209 IPC.
As you are a legal heir of your father, you can claim a share of his property by filing a partition suit.

A.Hi,
You can file a complaint against them for fraud and cheating under Sections 415 and 420 of the Indian Penal Code. You may also file a suit for malicious prosecution under S.209 IPC.
As you are a legal heir of your father, you can claim a share of his property by filing a partition suit.
