As my father passed away in 1999, Me and my mother are living with her father(my nana) since year 2000. She was the only one to take care of her father as her brothers (my Mama's) are living separately, and she did it well. My Mama's didn't treat my mother well as she was widowed. After her father passed away in 2012 her brothers started torturing my mother that they are the heir to their father's house and are forcing my mother to leave the house. We have no where to go and we have been living here for more than 17 years. Please advise us what can we do on legal base? Does the daughter have claim on her father's property after her father's death? We were not even paying any rent.
A.According to recent supreme Court decision both sons and daughters have equal right over the property of their parent father or mother.Tell your mother to file partion suit making parties all legal heirs of her father.Women r exempted from paying Court fee
